Collecting royalties

Rules for the collection of royalties, adopted by decision of the board.

English is provided for convenience. The Myanmar text is the authoritative version.

Introduction

  1. 1.a The Myanmar Music Content Organization (hereafter “MMCO”) is established under section 60(a) of the Copyright Law.
  2. 1.b Under section 62(c) of that Law, MMCO acts to distribute royalty entitlements to its member rights holders.
  3. 1.c MMCO administers members’ copyright interests and the rights they have entrusted to it, on terms mutually agreed.
  4. 1.d These collection rules are adopted by decision of the board for the purpose of collecting royalties on the works entrusted to MMCO, and will be revised as required.

How collection works

  1. 2.a Publisher members must give MMCO a catalogue of their works — both new releases and works already published — or notify it in advance. Notice should be given as soon as possible after a work is released or sent to the media.
  2. 2.b On receiving notice, MMCO proceeds through its agreed aggregators to license the bodies using the works and to recover the royalties due.
  3. 2.c MMCO collects royalties from the media on which music is used, including applications, YouTube and international streaming services (Apple Music, Spotify, Tidal and the like).

Live performance

  1. 3.a MMCO, and the companies and aggregators working with it, will:
  • provide a licensing service;
  • provide data collection services.
  1. 3.b Users are urged to notify MMCO before each live performance, with the details needed to account for it — the venue, the programme, the performers and the works to be performed — so that there is time to collect properly.

Categories of royalty collected

  1. 4.a Related rights royalties — collected from businesses that use recorded music commercially. For example:
  • use on FM radio;
  • use in singing competitions;
  • broadcast by television stations;
  • music played at events;
  • music played in shopping centres;
  • music used in karaoke establishments.
  1. 4.b Mechanical royalties — advances for physical distribution, and digital distribution (non-interactive, interactive and digital download).
  2. 4.c Synchronisation royalties — advances for the use of existing works in film, and advances for the recording rights in a current work or version.
  3. 4.d Printing royalties — the publication of a songbook containing the works of an MMCO member.

Rates

Works licensed for use on FM radio
750 kyats per play
Karaoke establishments (per room)
2,000 kyats per day

The artists’ share covers writing, singing, playing, recording and production.

  1. 5.c For the other categories above — singing competitions, television stations, events and shopping centres — rates will be set in consultation with partner CMOs, according to the extent of use.
  2. 5.d MMCO’s rules, including these collection rules and any announcements made from time to time, are published for public information on the organisation’s website, myanmarmusiccontent.org.
